LANSING ? The Michigan Economic Development Corp. Wednesday announced Michigan Strategic Fund approval of $6 million in funding for entrepreneurship and innovation programs as well as Michigan Business Development and Community Revitalization program incentives to eight companies that are expanding in the state.

The eight expansions are expected to generate up to $95.8 million in new capital investments and add 789 new jobs in Michigan.

Michigan Translational Research and Commercialization Program?? The MSF approved $6 million for innovation and entrepreneurship projects through the Michigan Translational Research and Commercialization Program. M-TRAC?is funded by the 21st Century Jobs Fund to create high-tech jobs through commercialization of university research and creation of university spin-offs in focused areas. MTRAC uses the nationally recognized Coulter Process to translate innovations into economic value.

The MSF approved the following awards for research commercialization:
* Michigan State University: $1,092,500 for agro-biotechnology and bioprocessing.
* University of Michigan: $2,415,000 for life sciences.
* University of Michigan: $150,000 for a pilot project in advanced transportation.
* Michigan Technological University: $517,500 for advanced applied materials.
* Wayne State University: $100,000 for a commercialization roadmap review (first tranche) with the possibility of receiving an additional $1,073,000 upon a revised proposal.
* Western Michigan University: $50,000 for a commercialization roadmap review.
* Eastern Michigan University: $50,000 for a commercialization roadmap review.
* MEDC: $552,000 for an incentive fund to reward the early commercial successes coming out of the M-TRAC programs.

The MSF also approved incentives for the following business expansions:

* A $1 million Community Revitalization Program performance-based grant has been awarded to 614 First Street Partners, LLC to renovate the former Miller Products Corp. factory into headquarters for the Rockford Construction Co. in?Grand Rapids. The project will transform the approximately 70,000 square-foot industrial building into corporate offices, a general trades yard and warehouse, commercial retail space for lease, an open-air courtyard and a community room. The project is expected to generate a total capital investment of up to $7.9 million and retain approximately 85 permanent full-time jobs.?Grand Rapids has approved a Brownfield Plan to assist in addressing brownfield issues.

* Baker Aerospace Tooling and Machining specializes in producing complex three-dimensional prototype parts and tooling for the aircraft, military and automotive industries. The company plans to expand in Macomb Charter Township, investing $9.86 million and adding 188 jobs. As a result of the expansion, Baker has been awarded an $800,000 Michigan Business Development Program performance-based grant. Michigan was chosen over a competing site in Florida. Macomb Charter Township has offered a seven-year Tool & Die Recovery Zone valued at $766,000 in support of the project.

*Black & Veatch Corp.?is a global engineering, consulting and construction company specializing in energy, water and telecommunications. The company has more than 9,000 employees and more than 100 offices worldwide, with 266 employees currently in Michigan. Black & Veatch is expanding its energy and telecommunication services sectors in?Ann Arbor. The company plans to invest at least $13.5 million and add 75 jobs, resulting in $435,000 Michigan Business Development Program performance-based grant. Michigan was chosen over competing sites in Arizona, North Carolina and Minnesota.

* Grand Rapids Downtown Market Holdings, LLC is constructing a 25,000 square foot market on multiple parcels in the City of Grand Rapids. The project will include indoor areas for a multi-vendor, year-round fresh food market, and space for a seasonal outdoor farmers? market and other food services. On-site surface parking will be provided, and machinery and equipment investments are related to outfitting kitchen and retail areas. The project will generate a total capital investment of approximately $30 million and create 295 new jobs. As a result, the project has been awarded a $3,000,000 Michigan Community Revitalization Program loan.?Grand Rapids is offering support to the project in the form of public infrastructure improvements valued at $4.7 million, and the Grand Rapids City Parking Commission has contributed $400,000 to the project.

* Heart of Howell, LLC?plans to fully renovate three historic properties in downtown Howell to prepare them for retail, office and commercial space. The project is expected to generate investment of $2.5 million and create 19 full-time jobs. The project has been awarded a Community Revitalization Program performance-based grant of $375,868.?Howell is providing support in the form of a DDA Fa?ade Grant valued at $58,000 and a 12-year Obsolete Property Rehabilitation Abatement valued at $94,196.

* Herbruck Poultry Ranch Inc.?is a family owned egg producer in Ionia County. The company has opportunities to expand its egg production and processing facilities, investing up to $17.2 million and creating 55 jobs. As a result of the expansion, Herbruck has been awarded a $500,000 Michigan Business Development Program performance-based grant. The Lakewood Wastewater Authority is offering to waive the sanitary sewer connection fee of $405,000.

* Parkland Muskegon Inc.?plans to renovate one of the only remaining buildings left of the structures that formerly comprised the downtown Muskegon Mall. The eight-story building will be converted into a residential apartment development, along with the construction of two-story addition to provide additional residential units. Improvements will include landscaping and parking lot for residents. The project will generate a total of $10.7 million in total capital investment and create two full time jobs, resulting in a $1.95 million Community Revitalization Program performance-based loan.

* Two Men And A Truck is the first and largest local moving franchise system in the United States, offering a full range of home and business moving services. The company has the opportunity to grow its number of franchise locations and plans to expand its corporate headquarters in Delhi Township, which will include support departments such as customer care, franchise business consultants, training and development, service desk and a call center.? The project will generate a total capital investment of up to $3.95 million and create 125 new jobs over the next five years. As a result of the expansion, the company has been awarded a $350,000 Michigan Business Development Program performance-based grant.

Wireless connections creep into everyday things

(AP) ? A car that tells your insurance company how you're driving. A bathroom scale that lets you chart your weight on the Web. And a meter that warns your air conditioner when electricity gets more expensive.

Welcome to the next phase of the wireless revolution.

The first wave of wireless was all about getting people to talk to each other on cellphones. The second will be getting things to talk to each other, with no humans in between. So-called machine-to-machine communication is getting a lot of buzz at this year's wireless trade show. Some experts believe these connections will outgrow the traditional phone business in less than a decade.

"I see a whole set of industries, from energy to cars to health to logistics and transportation, being totally redesigned," said Vittorio Colao, the CEO of Vodafone Group PLC, in a keynote speech at the Mobile World Congress in Barcelona, Spain. The British cellphone company has vast international interests, including its 45 percent ownership stake in Verizon Wireless.

Companies are promising that machine-to-machine, or M2M, technology will deliver all manner of services, from the prosaic to the world-changing. At U.S. chipmaker Qualcomm Inc.'s booth here at the show, there's a coffeepot that can be ordered to start brewing from a tablet computer, or an Internet-connected alarm clock. A former president of Costa Rica is also at the show, talking about how M2M can save massive amounts of greenhouse gases by making energy use more efficient ? enough to bring mankind halfway to the goal of halting global warming.

The M2M phenomenon is part of the larger drive to create an "Internet of Things" ?a global network that not only links computers, tablets and phones but that connects everything from bikes to washing machines to thermostats. Machina Research, a British firm, believes there will be 12.5 billion "smart" connected devices, excluding phones, PCs and tablets, in the world in 2020, up from 1.3 billion today.

But how does this transformation happen, and who stands to profit?

First, the devices have to be able to connect. That's not a trivial undertaking, especially considering that people don't upgrade washing machines or renovate their homes as often as they change cellphones and PCs. One company at the show, a Los Angeles-based startup named Tethercell, has an ingenious solution for battery-powered devices: a "fake" AA battery that houses a smaller AAA battery in an electronic jacket. It can be placed in a battery compartment with other batteries. Within a distance of 80 feet, some smartphones and tablets can then signal the "battery" to turn the device on or off. For instance, parents whose kids have a lot of noisy toys can turn all of them off with touch of a single button. A fire alarm could send a text-message warning that its battery is running low, rather than blaring an audio signal.

Unfortunately, a Tethercell from the first production run costs $35. Co-founder Kellan O'Connor believes the price can come down to $10, but that's still a non-trivial cost, and symptomatic of the high price of building out the Internet of Everything. For devices that need to connect at long range over a cellular network, the cost of radio components alone ranges from $10 to $70, according to analyst Dan Shey of ABI Research.

That's not expensive in the context of some big-ticket items, like cars, which have been forerunners when it comes to non-phone wireless connections. General Motors Corp. started equipping cars with OnStar wireless calling and assistance services in the mid-90s. At the show, it announced it is updating the service for faster data connections, enabling services like remote engine diagnostics and upgrades to the control software. AT&T Inc., which has been aggressive about getting into the M2M business, is ousting Verizon Wireless as the network provider for OnStar.

Colao, the CEO of Vodafone, gave an example of another "smart" car application that might seem intrusive to some: the company has been trying out a service in Italy that lets an auto insurance company know how much a car is being used, and charges premiums accordingly. It can also score the driver based on his or her driving style, and give pointers on how to handle the car more safely.

Cellular connections are creeping into smaller, cheaper devices. Ecooltra, which rents out electric scooters by the day in Spain, wants to connect them to the Internet, which would let renters figure out through their phones where there's a scooter for rent and how much of a charge is in its battery. The feature is perfect for quick, impromptu rentals by the hour. Adding "smarts" to the scooters in the shape of a cellular modem would turn the company from a conventional rental service to a "scooter-sharing" business, much like car-sharing services like Zipcar.

Once devices are connected, the next problem is getting them to talk to each other, and making sense of what they're saying. ABI's Shey says this is the real business opportunity in M2M, more valuable than making the modems or providing the wireless connections. He believes that's driving a behind-the-scenes scramble of deal-making at the show, as companies like AT&T seek to bolster their ability to support M2M by acquiring companies that provide a "middle layer" of software between the devices and their owners.

For connections between devices in the home, like that remote-controlled coffee-pot, Qualcomm touts its AllJoyn project, which it seeks to make an industry standard. Currently, the main ways for devices to connect to each other and figure out what they can do, like Bluetooth and DLNA, are too limited and difficult to use, said Rob Chandhok, president of Qualcomm Innovation Center.

With AllJoyn, "there's nothing to stop you from making a speaker that listens for notifications and turns them into speech, so you hear, 'Hey, you left the refrigerator door open!'" Chandhok said. "You take very simple things and connect them, and people build experiences on top of them. That's what we're trying to do."

Jose Maria Figueres, the former president of Costa Rica, is now the president of the Carbon War Room, an organization co-founded by billionaire Richard Branson to promote cutbacks in greenhouse-gas emissions through smart private enterprise. Figueres believes M2M has huge potential to wring efficiency out of energy-guzzling activities, and could reduce emissions equivalent to 9.1 billion tons of carbon dioxide by 2020 ? roughly equal to the combined emissions of India and the U.S. today.

Vodafone provided one example of how this might be done. The city of Groningen in the Netherlands has put sensors in the trash containers that serve public-housing units. They alert trash haulers when they need to be emptied, saving on unnecessary trips and reducing fuel use by 18 percent.

With M2M, "in many cases you have information moving instead of us moving," Figueres said.

In another example, Dutch authorities started controlling their street lights wirelessly rather than with "dumb" timers. They save on energy by dimming the lights if traffic is scant, but can also turn them on early if the day is dark.

Could M2M be overhyped ? a promise that won't deliver? The wireless industry is no stranger to rosy projections that don't pan out. Shey, the ABI analyst, thinks M2M will deliver, but perhaps not in a sexy, flashy way. When machine-to-machine connections are created, he said, it's usually not because someone is making a big bet on the future, but because they save money.

"It's about gaining more out of the asset that you have, like a truck. When it needs maintenance it gets maintenance at the right point. Or ensuring that the vending-machine guy only goes to the vending machine when it's empty," he said.

For more than two years, dealers have been bracing for possible actions by the Consumer Financial Protection Bureau, formed after the financial crisis of 2008.

Now the federal agency has taken its first auto-related action, and it appears to be aimed at a longstanding auto-lending issue: whether minorities are hurt unfairly by car dealers keeping a point or so of the interest rate on a car loan.

Beginning in the late 1990s, a string of lawsuits alleging discriminatory or predatory lending tied to the finance reserve were filed against various banks and the captive finance arms of Nissan, Ford, General Motors, Honda and other automakers. Most were settled by 2003, with the lenders agreeing to cap the finance reserve at two or three percentage points. That cap became the industry standard.

Now the CFPB is taking another look at the finance reserve and possible unfair lending practices.

This month the bureau put several auto lenders on notice after bank examinations turned up evidence of what the agency considers violations of the Equal Credit Opportunity Act, said Chris Stinebert, CEO of the American Financial Services Association, a Washington lobbying group.

Stinebert, whose group represents banks, captives and other lenders, said he doesn't know how many lenders received the letter. Bloomberg reported that the CFPB sent letters to "at least four" banks.

"We don't believe these investigations and these letters are warranted," Stinebert told Automotive News. "We are very concerned the CFPB is viewing this in a very selective, isolated way."

The National Automobile Dealers Association, in a statement, said, "Dealers are committed to ensuring that all categories of consumers are protected and treated fairly."

Dealership-assisted financing, or an indirect loan, "provides overwhelming consumer benefits," NADA said. Last year, NADA experts testified to the Federal Trade Commission that consumer interest rates for indirect loans are often cheaper than direct-to-consumer loans, even though dealerships are compensated for being a middleman on indirect loans, as a result of competition among lenders for dealers' business.

The CFPB declined to comment.

For most auto loans, dealerships tack an additional amount, called finance or dealer reserve, onto the interest rate the customer will pay. Today it's typically less than 2.5 percentage points and sometimes less than a single point.

That's the dealership's cut for negotiating the loan, finding the customer a lender and handling the paperwork. The lender, which typically prices the loan knowing that the dealership will add the finance reserve, returns most of the profit from the markup to the dealership.

Lobbyist Chris Stinebert: ?We don?t believe these investigations and these letters are warranted.?

Stinebert said the CFPB's case for discriminatory lending is based on the theory of disparate impact.

Disparate impact is what happens if legally protected classes, such as minorities or women, are charged more than other borrowers with similar qualifications. It doesn't matter whether the lender or the dealer intended to discriminate. Under the disparate impact theory only the results matter, based on statistical analysis, as CFPB Director Richard Cordray affirmed last week without talking about specific cases.

"From the perspective of a consumer disadvantaged by policies that have a discriminatory effect, it makes no practical difference whether a lender consciously intended to discriminate," he told the CFPB's Consumer Advisory Board last week. "Lenders whose policies provide incentives for brokers or loan officers to negotiate higher rates have often been shown to result in African-American and Hispanic borrowers paying more for mortgages and auto loans."

Lenders can't say the CFPB didn't warn them, at least in general terms. Without singling out auto lenders or dealers, the CFPB said last April it would employ disparate impact to go after discrimination.

Lawyer Michael Benoit, a partner at Hudson Cook in Hanover, Md., said consumer-advocate groups wonder whether auto lenders observe the industry rate standards. He said his clients include several large auto lenders.

The lenders he's aware of have stuck with those limits, and in fact actual finance reserve is much lower on average, Benoit said. He said the legal theory being advanced by the CFPB today is a "rehash" of the earlier discrimination lawsuits.

When the CFPB was created in 2010, dealerships were excluded from its jurisdiction -- except for buy-here, pay-here stores, which collect their own loans -- but not auto lenders.

A CFPB spokesman made it clear at the AFSA Vehicle Finance Conference in Orlando this month that the CFPB expects lenders to take "remedial action" with dealers when necessary.

"Lenders need to have a compliance program that includes the effects of their compensation system," said Rick Hackett, CFPB assistant director for installment and liquidity lending markets. "And where that compensation system has the effect of causing a disparate impact, the lender needs to consider whether a dealer interaction or other means are necessary."

Tyler Corder, CEO of Findlay Automotive Group in Henderson, Nev., has been warning dealers and lenders that tougher regulation for finance reserve was only a matter of time.

Corder's solution to the lost finance-reserve revenue is to sell more finance and insurance products, such as extended-service contracts, to make up the difference. The Findlay group has 27 locations, mostly in and around Las Vegas.

"I've been de-emphasizing finance reserve for several years," he said. "My guess has been that it would be more highly regulated, and now it looks like that's going to happen."

iTunes in the Cloud looks to be hitting parts of Europe with TV series, films

While stateside users might complain that we get all the good stuff in Europe first, Apple's iTunes in the Cloud for movies and TV shows has finally got around to rolling in to France and other parts of Europe, eons after it came out in the US. We confirmed that the new functionality works in France, which lets you buy films and TV shows from a computer, Apple TV or iOS device, then download it for free from the cloud on another. Others have reported by Twitter that it's working in Holland and Sweden as well, making it the first big move for the service since it rolled into the UK, Australia and Canada last summer. Until now, users in those nations were only able to download books, apps and music purchased in iTunes from the cloud. There's still no word from Apple about the move, however, and the list of supported countries hasn't been updated for those features -- so we'll enjoy it for now and hope Cupertino doesn't change its mind.

The YotaPhone is an example of one of the things we like the most about Android -- crazy hardware implemented in new and interesting ways. Dual-screen smartphones are nothing new -- recall the ill-fated Kyocera Echo of old. But Yota Devices' YotaPhone is the first we can recall that packs both a traditional LCD front and e-ink back, and today we went hands-on with the phone at Mobile World Congress. Both sides are coated in Corning Gorilla Glass 2, though the back has more of a matte texture to it. This gives the YotaPhone a unique appearance, which is accentuated by its slightly curved back.

Powering the YotaPhone is a dual-core Snapdragon S4 CPU at 1.5GHz. Around the back is a 12MP camera, and the power button cleverly doubles as a SIM tray. On the software side, it's near-vanilla Jelly Bean running the show -- Yota's left the Android UI mostly intact. Both screens are 4.3 inches diagonally, and the LCD clocks in at 1280x720 pixels. As you'd expect from the vanilla Android UI running on an S4 chip, the UI is smooth and lag-free.

The phone's also lacking traditional Android buttons -- instead, button commands are activated based on gesture controls on a panel under the LCD. Swipe halfway from right to left to go back, all the way to go home, and long press the middle for the task-switcher. Similarly, you can copy images from the front screen to the rear by swiping from top to bottom with two fingers.

Certain apps, such as Calendar and Weather, can also run natively on the rear display, and there's an in-app button for transferring things to the rear screen. This means you're able to view content without burning through quite so much juice -- and it could also be useful for viewing certain types of information in bright sunlight.

The YotaPhone probably won't be a mass-market seller in the West, but it is an incredibly cool device nonetheless, playing to the strengths of both LCD and e-ink. We've got hands-on photos and a quick video demo after the break.

The Consmer: Questions About a Robotic Surgery

Ever since it was approved by the Food and Drug Administration in 2005, robotic surgery for hysterectomy has been heavily advertised. Surgeons promise that using the da Vinci robotic device will bring better results and an easier recovery, and many hospitals claim that patients will experience less pain and fewer complications, getting back on their feet faster.

The company that makes da Vinci robotic surgery equipment promoted it last May at free health workshops organized by the federal Office on Womens? Health. On Sunday, the Liberty Science Museum in Jersey City will host its first ?Let?s Operate Day,? offering guests ?hands-on? practice peering into video monitors and using da Vinci?s robot arms to pick up and manipulate small objects.

The cost of the new technology is rarely mentioned. But last week, a new study that evaluated outcomes in more than a quarter of a million American women raised questions about the manufacturer?s claims. The paper, published in The Journal of the American Medical Association, compared outcomes in 264,758 women who had either laparoscopic or robotically assisted hysterectomy at 441 hospitals between 2007 and 2010. Both methods are minimally invasive and involve smaller incisions than open abdominal surgery.

The researchers found no overall difference in complication rates between the two groups, and no difference in the rates of blood transfusion, even though one of the claims regarding robotic surgery is that it causes less blood loss.

But the researchers did find a big difference in cost. Robotically assisted surgery for hysterectomy costs on average about one-third more than laparoscopic surgery.

?It?s important to separate the marketing from the data,? said Dr. Jason D. Wright, the study?s lead author, an assistant professor of obstetrics and gynecology at Columbia University Medical Center. ?For the surgeon, there is a greater degree of movement and control of the instruments and the visualization is better.

?But the ultimate question is, does this change outcomes for patients? This study suggests that there really is not a lot of difference as far as quantifiable outcomes.?

The majority of patients in both groups left the hospital in less than two days, though patients who had robotic surgery were slightly more likely to go home that early: 80 percent went home in less than two days, compared with 75 percent of those who had laparoscopic surgery.

But the cost of robotic surgeries was significantly higher, with a median cost to the hospital of $8,868, compared with $6,679 for laparoscopic hysterectomy. The study did not look at the difference in patients? bills, but according to Newchoicehealth.com, the average patient price for a laparoscopic hysterectomy ranges from $7,700 in Dallas to $11,600 in Los Angeles.

With laparoscopic surgery ? sometimes called keyhole surgery ? narrow instruments and a small video camera are inserted through tiny incisions; the surgeon sees the image on a monitor and can cut and sew tissue with the instruments. With robotically assisted surgery, the surgeon sits at a console with a 3-dimensional view of the surgical site, and computer technology translates his or her hand movements into precise, scaled movements of the instruments.

Even without offering clear advantages the proportion of hysterectomies performed robotically has increased rapidly, up to nearly 10 percent of hysterectomies in 2010 from less than 1 percent in 2007, Dr. Wright said. Minimally invasive surgeries for hysterectomies are increasing across the board, he found, even at hospitals not performing robotic surgery.

Dr. Myriam J. Curet, chief medical adviser to Intuitive Surgical, which makes the da Vinci systems, did not dispute the study?s findings, but said the important message was that more women were able to receive minimally invasive surgeries because more options were available.

?That?s good for patients and for the health care system,? Dr. Curet said. Women who are not candidates for laparoscopic surgery might still be candidates for robotically-assisted surgery, she added.

Right now, however, it is not clear how to identify which women would benefit from robotic surgery and which would do well with a less expensive method.

The growing use of robotic surgery in hospitals will continue to drive up health costs, said Joel S. Weissman, of Brigham and Women?s Hospital and a co-author of an editorial published with the study.

?Once you have that robot, the tendency is to use it for all kinds of things, for which it may or may not have great value,? Dr. Weissman said. Studies like this one, he said, demonstrate the waste of health care dollars on ?something that costs a lot more and doesn?t offer any added benefit over current treatment options.?

Each year approximately 600,000 American women have hysterectomies, according to the Centers for Disease Control and Prevention. By age 60, one in three American women has had her uterus removed, often along with her ovaries and cervix.

Critics who say far too many hysterectomies are done in the United States worry that all the attention to surgical method distracts from the question of whether patients should be having the surgery at all.

Most hysterectomies are prescribed for conditions that are not life-threatening, and advocates worry that women are not fully informed of the long-term harms, which may include a loss of sexual responsiveness, depression and chronic constipation, and higher risk for osteoporosis and heart disease, said Nora W. Coffey, the founder of the nonprofit Hysterectomy Educational Resources and Services Foundation.

?That?s the conversation we should be having,? Ms. Coffey said.


Nora W. Coffey and other experts emphasize that women considering a hysterectomy should discuss all options with their doctors.

?Ask what the alternatives are and whether watchful waiting is an option. Remember that it is irreversible, regardless of how the surgery is done.

?Learn about the nonreproductive functions of the uterus, ovaries and cervix, and the potential long-term consequences associated with their removal, as well as the function of the ovaries and cervix.

?If you proceed, discuss the advantages and disadvantages of different surgical methods with your doctor. Interview several surgeons and inquire about the cost and how much insurance will cover. Your co-pay may vary depending on the surgical method.

?Tell your surgeon if you do not want your ovaries and cervix removed.

Darden Restaurants, the owner of Red Lobster, Olive Garden, and LongHorn Steakhouse chains, announced last spring that it was investing in the world's first commercial lobster farm in Malaysia. ?

In an analyst conference today, the restaurant operator explained that it "sees global demand for lobster exceeding supply." ?

Since there isn't a limitless supply of lobsters in the wild, growing lobsters in captivity will increase the supply. The company hopes this will drive down prices for consumers and provide a buffer against the rising cost of seafood. ?

According to the Orlando Sentinel's?Sandra Pedicini, Darden has partnered with a? Malaysian group on a 23,000-acre aquaculture park.?

"After several years of?research and investment in hatchery technology, we?selected Malaysia as the site, as we intend to grow a?species of spiny lobster known as panulirus ornatus?indigenous to the region. While we?re excited about?the prospects for this initiative, it will be several years?(2017) before it?s operational and even longer (2029)?before production is expected to reach scale," Darden said in a 2012 report.?

Spiny lobsters, also known as rock lobsters, are distinguished by their lack of claws and short spines.?In comparison to true lobster (Maine lobster), it's more mild and bland.

By 2029, the company plans to produce up to 40 million pounds of spiny lobster with annual revenue of $ 1 billion, according to the Wall Street Journal. ?

Pirates, beware: industry, ISPs launch copyright alert system

LOS ANGELES (TheWrap.com) - The entertainment's industry new piracy warnings to computer users started flowing Monday as the industry and internet service providers finally launched their long-promised Copyright Alert System.

Announced in 2011 and originally set to begin by the end of 2012, the alert system is an effort by the movie, TV and recording industries and major cable providers to move much more swiftly to issue warnings whenever copyright owners discover that an account is being used to access or download pirated content.

The system was created by the Center for Copyright Information, which includes the six major studios, record labels such as Warner and EMI and internet giants such as Time Warner Cable, Verizon, AT&T and Cablevision. Along with the Motion Picture Association of America, the Recording Industry Association of America and the Independent Film and Television Alliance are also involved.

The alerts will go out automatically when internet service providers are notified that piracy has occurred - hopefully as soon as a day after the content is accessed.

In the new system, users will be directed to a landing page after receiving five to six warnings. That page will require them to contact their internet providers or respond to some educational materials.

Before their Internet access is restricted, users do have the option of requesting an independent review, at a cost of $35.

The center describes the notices as "educational." Illegal down loaders will get up to six notices urging them to switch to legal content sources. If they don't respond, they could find themselves facing slowed internet connections and possibly other sanctions.

There does have to be evidence that the user actually accessed pirated content; just going to a pirate site would not cause sanctions. Just visiting PirateBay.com, for example, doesn't prove they are accessing a movie that Disney owns.

One way the content providers will recognize illegal downloading is that all files have numbers. A YouTube file, for example, has a unique ID, and if Disney recognizes an ID being illegally downloading, it can submit a claim.

The warnings are an alternative to the court enforcement that the MPAA and content providers had once sought to implement. That procedure, however, proved to be fraught with problems. For example: It would be difficult to determine exactly what court would have jurisdiction over such cases, and court notices would take time to process.

Under the alert system, notice of a violation - along with an educational message - will be immediate.

Though content owners aren't ruling out legal actions, "Content owners and ISPs believe a voluntary system that speaks to consumer is the best way to fight piracy," Jill Lesser, the center's executive director, told TheWrap. They are hopeful that the voluntary system will be more efficient and a less expensive way to stop copyright piracy, she said.

Lesser said that the test of the alerts will be whether copyright violations decrease and how many challenges are won by consumers who complain that they were wrongfully notified.\

Consumer groups on Monday had some mixed reaction to the rollout.

Corynne McSherry, intellectual property director for the Electronic Frontier Foundation, said she is worried both that the "education" the center provides would offer consumers an arbitrary view of copyright with little information on fair use.

She also said she is concerned ISPs could set arbitrary rules for access and move more swiftly to impose sanctions.

"At least when you go to court, there is a question of due process," she told TheWrap. "They have created their own private law system here where consumers don't have the protection normally afforded the accused. It's really quite dangerous."

Consumers could end up getting notices for having open wireless systems that in court would be legal, she said.

Another consumer group concerned about copyright issues, Public Knowledge, has signed on to the system.

"The Copyright Alert System will be a significant test of whether a voluntary copyright-enforcement system can work while at the same time protecting the rights of Internet users, Public Knowledge President Gigi Sohn, who is on the Center's advisory board, said in a statement. "The creators of the system have taken steps to build in consumer protections and fair process to the system, and it is my hope that it will succeed."

Sohn said that critical to the program's success is transparency about information about the notices and the number successfully challenged.

"I will continue to use my role on the Advisory Board to ensure that internet users' rights are protected; that the process provided under the CAS is robust and accessible; and that the CAS operates transparently and with public input," she said.

Heat blow huge lead then beat Cavs for 11th in row

MIAMI (AP) ? Dwyane Wade got hot down the stretch, and LeBron James missed a layup in the final minute.

Both were huge breaks for the Miami Heat.

James scored 28 points, Wade scored 11 of his 24 in the final five minutes ? when Miami needed him most ? and the Heat extended the NBA's longest current winning streak to 11 games, beating the Cleveland Cavaliers 109-105 in a back-and-forth matchup Sunday night.

The Heat blew a 22-point second-half lead then rallied from eight down with 5:16 left.

"We're a veteran ballclub and we've been in every situation that an NBA game can offer us," James said. "We don't get too high, we don't get too low, we just play the 48 minutes out and see where it takes us."

Dion Waiters scored 26 points, C.J. Miles added 19 and Kyrie Irving scored 17 for Cleveland, which outscored Miami by a stunning 30 points over a 17-minute stretch of the second half, yet still came up empty.

The Cavaliers are now 1-8 against the Heat since James signed with Miami in July 2010.

"We had a very good chance against a very good basketball team, the world champions, and we lost the game because of mental mistakes," Cavaliers coach Byron Scott said. "That's just something that we can't have happen again."

In fairness, it wasn't just mental mistakes that doomed Cleveland late. There was a bit of luck involved for the Heat.

Miami was up by two and held possession with 1:03 remaining. The shot clock was running down and Chris Bosh was open to try a 16-footer from the right wing. As Bosh was about to release, James got inexplicably free under the basket, thrusting both his arms skyward. Bosh threw him the pass ? and James, enjoying the best shooting season of his career, did the unthinkable: He missed the easy one.

This is where the luck comes into play.

The rebound found its way back to Bosh, the Heat ran down another shot clock, and Wade got loose for a two-handed dunk that pushed Miami's lead to 105-101 with 24.4 seconds left.

It was a double-whammy for Cleveland. Miami scored and took nearly 40 seconds off a dwindling clock in the process.

"Hey, I'm a smart player. That's what basketball IQ is all about," James said afterward, unable to hold back a sly grin. "I have no idea how I blew that layup. But it did work out for us. Got an extra possession, D-Wade was able to turn the corner and get a slam."

Said Heat coach Erik Spoelstra: "I liked that play."

Wade started what turned into a 16-4 run with a fadeaway with just under 5 minutes to go, then added a three-point play on the next Miami possession to cut the Cavs' lead to 97-94.

And after Irving missed a layup with 1:35 left, Wade got the rebound and set up Battier for a 3-pointer that put Miami on top again ? and for good.

"I thought that we had the game," Cavaliers forward Alonzo Gee said.

Sure looked like that was the case, after a ridiculously good third quarter.

Down 68-46 early in the third, the Cavaliers looked finished ? last-place team, on the road, against the reigning NBA champions who just happened to have the league's longest current winning streak.

Midway through the third, Miami's lead was still 17.

With two minutes left in the period, the cushion was 10.

By the start of the fourth, it was nonexistent.

The C.J. Miles Show lasted for all of 63 seconds. And they were a scintillating 63 seconds.

It starts with 1:35 left, a 3-pointer from Miles getting the Miami lead down to seven. Then he got a rebound, came downcourt and connected on another 3-pointer. Lead down to four. Another stop by the Cavs on one end, then another 3-pointer for Miles on the other ? that one coming both with him drawing a foul from Chalmers, and with Spoelstra getting hit with a technical from referee Ed Malloy for arguing.

Miles made the technical free throw to tie the game, the free throw for the Chalmers hit to put the Cavs ahead, and they carried that 82-81 lead into the fourth, having closed the quarter on a 36-13 run.

"Guys just finally decided to start playing," Miles said.

Miami used a 23-4 run in the first half to take what looked like a commanding 42-22 lead ? with more than 9 minutes left until the break. And after Cleveland got within seven, Miami answered with another burst.

James didn't miss in the final 4:29 of the half, scoring 10 points on a 4-for-4 run from the floor and fueling what became 16-5 spurt that gave Miami a 64-46 lead going into the locker room. And for good measure, Miami got the first two baskets of the second half, pushing the lead to 22, the biggest of the night.

Over, right?

Not even remotely close. Not until the final frantic seconds, as the Heat not only extended their win streak but won for the fourth time in five nights.

"We found a way," Wade said. "I felt like in the first three quarters, I couldn't move. But in the fourth, you just find it. ... We just turned that other switch on."

NOTES: Miami's two wins over Cleveland this season, both at home, have come by a combined six points. ... Hubble sees a glowing jet from a young star

Feb. 24, 2013 ? The Hubble Space Telescope has captured a new image showing an object known as HH 151, a bright jet of glowing material trailed by an intricate, orange-hued plume of gas and dust.

It is located some 460 light-years away in the constellation of Taurus (The Bull), near to the young, tumultuous star HL Tau.

In the first few hundred thousand years of life, new stars like HL Tau pull in material that falls towards them from the surrounding space. This material forms a hot disc that swirls around the coalescing body, launching narrow streams of material from its poles. These jets are shot out at speeds of several hundred kilometers (or miles) per second and collide violently with nearby clumps of dust and gas, creating wispy, billowing structures known as Herbig-Haro objects -- like HH 151 seen in the image.

Such objects are very common in star-forming regions. They are short-lived, and their motion and evolution can actually be seen over very short timescales, on the order of years. They quickly race away from the newly-forming star that emitted them, colliding with new clumps of material and glowing brightly before fading away.

Sports ? Fans hurt as crash mars NASCAR race

DAYTONA BEACH, Fla ?

A frightening, fiery crash sent Kyle Larson?s car airborne and debris spinning into the stands injured dozens of race fans Saturday at the NASCAR stock car Nationwide Series season-opener.

Joie Chitwood, president of Daytona International Speedway, said 14 injured fans had been transported from the circuit for treatment at local hospitals and 14 more were treated at the track?s medical facility.

He said he could not confirm reports that at least two people were seriously hurt and that one was taken immediately for surgery.

?It?s not appropriate for me to comment on that,? Chitwood said in a press conference held at the circuit some three hours after the wreck.

Various media reports put the number of injured at more than 30, with ESPN reporting that one adult had life-threatening head trauma and a 14-year-old was in critical but not life-threatening condition in hospital.

The wreck, which occurred almost as Tony Stewart was taking the checkered flag for victory, began when race leader Regan Smith turned sideways and a dozen cars bunched behind him.

?My fault,? admitted Smith. ?I threw a block.?

Larson, a Japanese-American driver who was making his first start in NASCAR?s second-tier series, was launched into the catch-fencing.

?I was getting pushed from behind, and by the time my spotter said, ?Lift,? it was too late,? said Larson, who was able to climb out of what remained of his vehicle.

?I had some flames come in the cockpit. I was alright and could get out of the car quickly. It was definitely a big hit.?

Larson?s car tore a hole in the fence separating the track from the stands. His engine sheared off with at least one tire and other debris flying into the grandstand.

?I looked in the mirror and that?s the worst image I?ve ever seen in a race in my life,? Stewart said.

A fan who identified himself only as ?Tyler? sent amateur video to ESPN and spoke with the sports network about the scary scene.

?I saw a tire about 10 feet from me, just a row above me with a man under it and people yelling for help,? he said in a telephone interview.

?Our prayers and thoughts are with everybody they are working on,? NASCAR President Mike Helton said of those being treated by medical personnel.

None of the drivers involved in the crash was injured, but driver Michael Annett was hospitalized with chest bruising after hitting a safety barrier in an earlier crash in the race.

?We?ve always known since racing started this is a dangerous sport,? a subdued Stewart said. ?As much as we want to celebrate, I?m more concerned about the fans and the drivers right now.?

Chitwood said speedway and NASCAR officials responded appropriately and according to their safety protocols, with emergency personnel in place and able to begin work promptly.

Steve O?Donnell, NASCAR?s senior vice president for racing operations, said the entire incident would be reviewed to see what, if any, changes could be made to improve safety.

Until then, he declined to speculate on what went wrong or right.

?We need to take the time to really study it and see what we can improve on,? O?Donnell said.

The race came on the eve of the season-opening event in NASCAR?s top-flight Sprint Cup series, the Daytona 500.

Both O?Donnell and Chitwood said they expected Sunday?s race to start on schedule.

?We expect to go racing tomorrow with no changes,? Chitwood said.

Danica Patrick will start the Daytona 500 from pole position after becoming the first woman to top qualifying for a NASCAR race.

Patrick had also picked up a ride for Saturday?s race, driving for Turner Scott Motorsports. She suffered engine failure early on and wasn?t involved in the late-race chaos.

Authorities: Report of gunman at MIT was a hoax

CAMBRIDGE, Mass. (AP) ? An unfounded report of a gunman at the Massachusetts Institute of Technology that briefly caused a campus-wide lockdown Saturday stemmed from an electronic message sent to police, authorities said.

Officers searched for a man reported to be carrying a long rifle and wearing body armor but found nothing unusual, Cambridge police said. The report turned out to be a hoax, and there was no threat to public safety, state police spokesman David Procopio said.

Cambridge police received the tip in an electronic chat message around 7:30 a.m., but witnesses on the scene eventually contradicted it, spokesman Dan Riviello said. MIT sent two emergency alerts via text message, urging people to stay indoors. Less than an hour later, police posted on Twitter that the scene was clear.

Investigators are trying to identify the prankster and will pursue criminal charges if they do, Riviello said.

He declined to provide additional details or confirm reports that the IP address used by the prankster has been traced to New York, saying "as it is an active and ongoing investigation, I cannot release any additional information at this time."

About 11,000 people attend the prestigious school outside Boston where students are famous for their smarts as well as their stunts, including once putting a police car on top of a domed campus building.

(AP) ? Fans feeling unsafe after the horrific crash at Daytona International Speedway were able to change seats for NASCAR's biggest race.

Track President Joie Chitwood said Sunday workers successfully repaired a section of fence ? 54 feet wide and 22 feet high ? that was shredded Saturday when Kyle Larson's car went airborne on the final lap of a second-tier race and crashed through the barrier that separates cars from fans. Large pieces of debris, including a tire, sprayed into the upper and lower section of the stands.

The crash injured more than 30 people, raising more questions about fan safety at race tracks.

Halifax Health spokesman Byron Cogdell said seven people with crash-related injuries remained hospitalized Sunday in Daytona Beach in stable condition. The six people brought to a different Halifax hospital in Port Orange with crash-related injuries had all been discharged by Sunday morning, Cogdell said.

A spokeswoman at Florida Memorial Medical Center would not release information Sunday on the patients brought to that hospital.

Chitwood, meanwhile, said if any fans are uncomfortable with their up-close seating for Sunday's Daytona 500, officials would work to move them. The race started as scheduled.

"If fans are unhappy with their seating location or if they have any incidents, we would relocate them," Chitwood said Sunday. "So we'll treat that area like we do every other area of the grandstand. If a fan is not comfortable where they're sitting, we make every accommodation we can."

Larry Spencer of Nanticoke, Pa., said Sunday he's not sure he wants to ever sit that low again after his 15-year-old brother, Derrick, needed three stitches in his cheek after being hit by metal debris flying from the crash. They sat close to the fence Saturday, but returned for the Daytona 500 with tickets dozens of rows farther away from the track.

"I thought it was just neat to see the cars going by that close," Spencer said. "After yesterday, though, I definitely will reconsider sitting lower ever again."

The tire that flew into the stands landed a couple of rows above where they had been standing. After the crash, looking around at the people seriously injured, Spencer said he decided to take his brother to a hospital himself so that speedway crews and paramedics could focus on the people who needed more help.

"The only way to describe it was like a bomb went off, and the car pretty much exploded," Spencer said.

Track workers finished repairs about 2 a.m. Sunday, having installed a new fence post, new metal meshing and part of the concrete wall.

Officials decided not to rebuild the collapsed cross-over gate, which allows fans to travel between the stands and the infield before races.

Daytona has a grandstand remodel planned. Chitwood said the injuries could prompt a redesign that might include sturdier fences or stands further away from the on-track action.

"It's tough to connect the two right now in terms of a potential redevelopment and what occurred," Chitwood said. "We were prepared yesterday, had emergency medical respond. As we learn from this, you bet: If there are things that we can incorporate into the future, whether it's the current property now or any other redevelopment, we will.

"The key is sitting down with NASCAR, finding out the things that happened and how we deal with them."

Daytona reexamined its fencing and ended up replacing the entire thing following Carl Edwards' scary crash at Talladega Superspeedway in Alabama in 2009. Edwards' car sailed into the fence and spewed debris into the stands.

"We've made improvements since then," Chitwood said. "I think that's the key: that we learn from this and figure out what else we need to do."

NASCAR plans to take what remained of Larson's sheared car along with debris back to its research and development center in Charlotte, N.C., for testing.

"We'll bring in the best and brightest," said Steve O'Donnell, NASCAR's senior vice president for racing operations. "Anything we can learn will be put in place. ... Fans are our first priority. Obviously we want everybody to be safe at an event. We've talked to the speedway. We're confident in what's in place at today's event. Certainly still thinking about those affected, but we're confident to move forward for this race."

The 12-car crash began as the front-runners approached the checkered flag. Leader Regan Smith attempted to block Brad Keselowski for the win, triggering a pileup that could have been much worse.

Larson's burning engine wedged through a gaping hole in the fence. Parts and pieces of his car sprayed into the stands, including a tire that cleared the top of the fence and landed midway up the spectator section closest to the track.

The 20-year-old Larson stood in shock a few feet from his car as fans in the stands waved frantically for help. Smoke from the burning engine briefly clouded the area, and emergency vehicles descended on the scene.

Ambulance sirens could be heard wailing behind the grandstands at a time the race winner would typically be doing celebratory burnouts.

"It was freaky. When I looked to my right, the accident happened," Rick Harpster of Orange Park said. "I looked over and I saw a tire fly straight over the fence into the stands, but after that I didn't see anything else. That was the worst thing I have seen, seeing that tire fly into the stands. I knew it was going to be severe."

In 1987, Bobby Allison's car lifted off the track at Talladega while running over 200 mph, careening into the steel-cable fence and scattering debris into the crowd. That crash led to the use of horsepower-sapping restrictor plates at Talladega and its sister track in Daytona, NASCAR's fastest layouts.

As a result, the cars all run nearly the same speed, and the field is typically bunched tightly together ? which plenty of drivers have warned is actually a more dangerous scenario than higher speeds.

"That's one of the things that really does scare you," Allison said Sunday. "But it's always a possibility because of the speeds, where they are."
